Data Request Policy

This document forms an integral part of NashirNet's approved Terms and Conditions and must be interpreted and applied together with them. Together, they form the legal and regulatory framework governing the relationship between the Company and the Customer.

Using the website, creating an Account, requesting or using any Service, or continuing to use it constitutes an acknowledgment that you have read and understood this document and expressly and bindingly agree to all of its provisions.

If there is any conflict between the provisions of this document and the Terms and Conditions, the general Terms and Conditions shall prevail, unless the conflict relates to a matter specifically governed by this document. In that case, the provisions of this document shall prevail only in relation to that matter.

This Policy explains the types of data requests that NashirNet may receive and the legal and procedural controls governing how such requests are handled, in a manner that ensures compliance with applicable laws and preserves the rights of Customers and relevant parties.

Privacy Notice:

All data requests are subject to NashirNet's approved Privacy Policy.

The Privacy Policy sets out the general framework for collecting, using, and protecting data, while this Data Request Policy defines the process for handling official or legally authorized requests relating to the disclosure, preservation, or access of data.

Scope of the Policy:

This Policy applies to all data requests received by NashirNet relating to its Customers' Accounts or Services, whether submitted by:

  • Judicial authorities.
  • Law enforcement authorities.
  • Competent regulatory authorities.
  • Third Parties with a legitimate interest under applicable laws.

Types of Data Requests:

NashirNet may receive the following types of requests:

First: Data Requests

A Data Request means any official request to obtain information or documents relating to Customer Accounts in connection with:

  • Official criminal investigations.
  • Pending legal proceedings.
  • Authorized legal or regulatory procedures.

NashirNet responds to Data Requests only when they are submitted through official legal procedures issued by a competent authority within the Kingdom of Saudi Arabia. Such requests are handled in accordance with applicable laws.

Data Requests include, without limitation:

  • Summonses.
  • Court orders.
  • Search warrants.
  • Search and investigation warrants.
  • Any other legally enforceable procedures.

Second: Preservation Requests

NashirNet may be requested to temporarily preserve records or data associated with Customer Accounts for the purposes of official investigations or legal proceedings.

For a Preservation Request to be accepted, it must include the following:

  • Clear identification of the relevant Account or Accounts.
  • Identification of the requesting authority and the legal basis of its jurisdiction.
  • Reference to the relevant pending proceeding or investigation.
  • An undertaking to take the necessary legal steps to obtain a legal order authorizing access to the preserved data.
  • An official signed letter from the authority submitting the Preservation Request.
  • Approved contact details for the requesting authority, including an official email address and telephone number.

Third: Requests for Disclosure of Non-Public Domain Name Registrant Data

As a reseller of certain Domain Names subject to ICANN policies, NashirNet may be required to review requests submitted by Third Parties with a legitimate interest for the disclosure of non-public Registrant data:

  • Within the limits of applicable laws.
  • With due regard for the rights of Data Subjects.
  • In accordance with the applicable regulatory requirements relating to privacy protection.

No data shall be disclosed until the lawfulness of the request has been verified and all legal requirements have been satisfied.

Customer Notification of Disclosure Requests:

As a general rule, NashirNet shall notify the Customer of any official request to obtain their data unless such notification is expressly prohibited under applicable law or by a binding court order.

Information Required in the Request:

For any Data Request to be considered, it must include, at a minimum, the following:

  • The Customer's full name.
  • The email address associated with the Account.
  • The Domain Name and/or IP address associated with the Service.

NashirNet reserves the right to request supporting documents, including a copy of the complaint or evidence demonstrating that the requested data is connected to an existing legal proceeding.

Submission of Requests:

Data Requests must be submitted exclusively through one of the following methods:

  • An official letter addressed to the relevant department within the Company.
  • The approved email address designated for this purpose.

If no response is received by email, it is recommended that the request be resubmitted or sent through another approved communication method to ensure its receipt.

Fees and Costs:

To the extent permitted by law, NashirNet reserves the right to recover the costs incurred in processing Data Requests. Additional fees may be charged for unusual requests or requests requiring specialized technical or legal effort.

Scope of Data That May Be Disclosed:

  1. Non-Content Data:
    Upon receiving a valid legal request, the response may be limited to non-content data, such as:
    • Name.
    • Email addresses.
    • Account creation date.
    • Billing information.
    • IP address logs.
  2. Content:
    NashirNet does not disclose Customer content, such as website files, email content, or stored data, except pursuant to a specifically defined search warrant issued by a competent judicial authority.

Final Provisions:

  • This Policy does not constitute an undertaking to disclose any data beyond what is required by law.
  • NashirNet reserves the right to reject any request that does not satisfy the applicable legal or procedural requirements.
  • This Policy must be interpreted and applied together with the Terms and Conditions and the Privacy Policy.

If there is any conflict between the provisions of this Policy and the Terms and Conditions, the general Terms and Conditions shall prevail, unless the conflict relates to a matter specifically governed by this Policy. In that case, the provisions of this Policy shall prevail only in relation to that matter.
