This document forms an integral part of NashirNet's approved Terms and Conditions and must be interpreted and applied together with them. Together, they form the legal and regulatory framework governing the relationship between the Company and the Customer.
Using the website, creating an Account, requesting or using any Service, or continuing to use it constitutes an acknowledgment that you have read and understood this document and expressly and bindingly agree to all of its provisions.
If there is any conflict between the provisions of this document and the Terms and Conditions, the general Terms and Conditions shall prevail, unless the conflict relates to a matter specifically governed by this document. In that case, the provisions of this document shall prevail only in relation to that matter.
Please read this Agreement carefully before requesting or using any Domain Name registration Services.
Definitions and Terms:
For the purposes of this Agreement, the following terms shall have the meanings set out below unless the context requires otherwise:
- Internet Corporation for Assigned Names and Numbers (ICANN):
The international non-profit organization responsible for overseeing the Domain Name System (DNS), accrediting Domain Name Registrars, and establishing policies governing the registration and management of Domain Names.
- Registry:
The entity responsible for managing and operating a Top-Level Domain (TLD or ccTLD), maintaining the database of Domain Names associated with it, and establishing the regulatory rules applicable to that domain.
- Domain Name Registrar:
An entity accredited by ICANN to provide Domain Name registration and management Services and acting as a technical and regulatory intermediary between the Registrant and the Registry.
- NashirNet:
A company that provides Domain Name registration Services as a reseller or authorized intermediary of a Domain Name Registrar and is not the owner or operator of the Registry.
- Registrant:
The natural or legal person who registers the Domain Name in their name and is considered the legal holder of the right to use the Domain Name throughout the registration period, in accordance with the policies of the applicable Registry and ICANN.
Customer Information Requirements (Registrant):
The Registrant must provide correct, accurate, and current information as part of the Domain Name registration process, including, without limitation:
- The Registrant's name and postal address.
- The name, postal address, email address, and telephone numbers of the administrative, technical, and billing contacts.
- The primary and secondary name servers for the Domain Name.
- The Registrant undertakes to update this information immediately whenever any change occurs throughout the Domain Name registration period and bears full responsibility for any consequences resulting from inaccurate or outdated information.
Domain Name Renewal Terms:
- Automatic Renewal:
- The automatic renewal option is enabled by default when Domain Names are registered.
- The Domain Name is automatically renewed for a period equal to the original registration period.
- The renewal Invoice is automatically issued according to NashirNet's applicable prices at the time of renewal.
- The renewal fees are charged to the registered payment method.
- If payment fails, the automatic renewal will not be completed.
- Manual Renewal:
- The Registrant may disable automatic renewal and renew the Domain Name manually before its expiration date.
- The Registrant bears full responsibility for renewing the Domain Name before it expires.
- If the Domain Name is not renewed on time, it may be cancelled or additional fees may apply.
- Cancelled Domain Names may be subject to grace and redemption periods in accordance with the Registry's policies.
- Grace periods and redemption costs vary according to the Registry's terms applicable to the relevant Top-Level Domain (TLD).
Domain Name Transfer Terms:
- Domain Name transfers are subject to the transfer policies adopted by ICANN.
- The Registrant bears full responsibility for any risks resulting from the transfer process.
- A transfer requires the Domain Name to be unlocked and the authorization code (EPP) to be obtained.
- The registration period is automatically extended by one year after the transfer is successfully completed, in accordance with the Registry's policies.
- The Domain Name cannot be transferred during applicable regulatory lock periods, such as the first 60 days following registration or transfer.
- Enabling the Registrar Lock feature to prevent unauthorized transfers is the sole responsibility of the Customer.
Customer Obligations (Registrant):
The Registrant acknowledges and agrees to the following:
- NashirNet provides Domain Name registration Services as an intermediary or reseller.
- Compliance with all terms and policies issued by:
- The Domain Name Registrar.
- The Registry.
- ICANN.
- Acknowledgment that NashirNet, the Registry, and ICANN have independent authority and that NashirNet is not responsible for the decisions of those entities.
- Indemnifying NashirNet against any damages or claims resulting from the Registrant's violation of those policies.
- Acknowledgment that registering a Domain Name does not provide immunity from disputes or legal objections.
- Acknowledgment that the Domain Name may be suspended, cancelled, or transferred in compliance with court or regulatory orders or dispute resolution policies.
Payments and Fees:
- The Registrant must pay all fees relating to the registration or renewal of Domain Names.
- All fees are non-refundable, in whole or in part, even if the Domain Name is suspended, cancelled, or transferred before the end of its registration period.
Cancellation and Suspension:
The Domain Name registration may be suspended, cancelled, or transferred in accordance with Registry or ICANN policies in the following circumstances:
- Violation of this Agreement or any related policies.
- Failure to pay the applicable fees.
- Providing inaccurate or outdated information.
- Compliance with court or regulatory orders or requests from law enforcement authorities.
- Dispute resolution requirements or the avoidance of any legal liability.
Final Provisions:
- This Agreement forms a supplementary part of the Terms and Conditions.
- This Agreement does not create any obligation to guarantee the availability or continued registration of the Domain Name beyond what is determined by the policies of the Registry and ICANN.
- This Agreement remains effective throughout the Domain Name registration period.
- The version published on NashirNet's website is the official and binding version.
