Microsoft Product Usage Terms

This document forms an integral part of NashirNet's approved Terms and Conditions and must be interpreted and applied together with them.

This document governs the terms and controls applicable to the use of Microsoft Products that may be provided by NashirNet or used by the Customer as part of the Services, thereby defining the scope of responsibilities and obligations among the relevant parties.

Scope of Application:

This document applies to all uses of Microsoft Products associated with NashirNet's Services, whether the Products are:

• Provided by NashirNet under approved licensing programs.
• Used or installed directly by the Customer, whether obtained from Microsoft or any Third Party.

Legal Reference:

The use of any Microsoft Products is exclusively subject to the terms, conditions, and customer agreements approved by Microsoft, which constitute the primary and binding reference in this regard.

Usage Models:

1. Products Provided by NashirNet:
   Where NashirNet provides Microsoft Products as part of its Services, such Products are provided under approved licensing programs and are subject to Microsoft's terms, in addition to the terms governing the Service provided by NashirNet.
2. Products Provided by the Customer:
   Where the Customer uses or installs Microsoft Products obtained directly from Microsoft or from a Third Party, the Customer is fully responsible for:
   • The validity of the license.
   • Compliance with Microsoft's terms.
   • Any legal or financial obligations associated with the use of such Products.

NashirNet assumes no responsibility for such Products or their licenses.

Responsibility and Compliance:

The Customer bears full responsibility for the use of Microsoft Products, including:

• Compliance with all Microsoft terms and agreements.
• Ensuring lawful and properly licensed use.
• Compliance with applicable laws and regulations.

NashirNet assumes no legal, financial, or operational responsibility arising from:

• Unlicensed use.
• Violation of Microsoft's terms.
• Any dispute between the Customer and Microsoft.

Limitations of NashirNet's Liability:

NashirNet is not a representative, agent, or authorized delegate of Microsoft and provides no warranties or undertakings on its behalf.

NashirNet also assumes no responsibility relating to:

• The content, interpretation, or enforcement of Microsoft's agreements.
• Any changes or updates to Microsoft's terms.
• Any failures or issues resulting from Microsoft Products.

Technical Support:

NashirNet's support is limited to the scope of the Services it provides and does not include specialized Technical Support for Microsoft Products unless expressly stated as part of the applicable Service.

The Customer is responsible for obtaining Technical Support from Microsoft or the relevant specialized parties when required.

Restricted Uses:

Certain Microsoft Products may be subject to specific usage restrictions, including, without limitation, restrictions relating to government use or regulated sectors.

The Customer is responsible for ensuring that its use complies with such restrictions and for contacting Microsoft when necessary to obtain the appropriate licenses or agreements.

Amendments:

NashirNet reserves the right to update or amend this document at any time in accordance with changes to its Services or Microsoft's terms.

Continued use of the Services after the amendments are published constitutes implied acceptance of those amendments.
