This agreement is between the client and Nashirnet , and it should be fully read . In case of signing the contract or making an order online , you're fully agree on the terms in this agreement.
Nashirnet is not monitoring the servers content and it has the right to suspend any service upon a formal letter for complaint until the client contact with the complaint and solve the problem .
Using any illegal softwares or Violation of intellectual property rights Authorizes Nashirnet to suspend the service upon a formal complaint until the client solve the issue.
Nashirnet will suspend any service participating in DOS/DDOS attack until resolving the issue.
Nashirnet will suspend any service under DOS/DDOS attack until resolving the issue.
Nashirnet will not unsuspended any service under DOS/DDOS until the technical team make sure that the issue has been resolved and the client has no right to prompt on that.
Suspended service due to DOS/DDOS attacks will be terminated in case the attack has been repeated for the second time.
Nashirnet will not compensate or refund any client for his suspended/terminated service due to DOS/DDOS attacks.
Nashirnet is not responsible about any financial or emotional damage resulting of suspension/termination of a service due to DOS/DDOS attacks.
Sending spam emails Authorizes nashirnet to suspend the service upon a formal complaint.
Participating in an attack on other servers or being under attacke Authorizes nashirnet to suspend the service until solving the problem.
Publishing malwares,attack softwares or unethical content autherize Nashirnet to suspend the service untill solving the problem.
In case of exceeding the service monhly bandwidth limit , the service will be suspended untill the begining of the next month , and it's the client responsibility to monitor his service monthl bandwidth usage from his web control panel . And incase the client would like to have extra monthly bandwidth , he should contact Nashirnet sales team.
All payments are for requested services and not refundable or used for other services for any reason.
In monthly billing cycle , an invoice reminder will be sent to the client before 5 days of the invoice due date.
In quarterly billing cycle , an invoice reminder will be sent to the client before 10 days of the invoice due date.
In semi-annually billing cycle , an invoice reminder will be sent to the client before 15 days of the invoice due date.
In annually billing cycle , an invoice reminder will be sent to the client before 30 days of the invoice due date.
Invoice overdue autherize Nashirnet to suspend the service untill the invoice payment placed.
Invoice overdue autherize Nashirnet to suspend and even terminate the service unless the payment placed, and the client has no right to ask for any data or backups.
All charged related to the requested service considered prepaid charges , and Nashirnet will not be considered responsible for any loss or damage resulting of terminating the service after the service period ends and the client didn'r renew it.
Nashirnet has the right to reject any service order for a person,group or a company without specifying the reasons , also Nashirnet has the right to terminated any service with many complains on it.
The client has the right to ask for the service details once the service invoice has been paid in fully and a reciept has been sent to Nashirnet accounting Dept. In case of wire transfer payment type.
All paid amounts are not refunable , and the client can't replace any service with another one.
Nashirnet undertakes the privacy of the client personal details unless has been requested formally by a governmental institute .
Nashirnet will sent the service details to the client email address registered in the system , and it's the client responsibility to secure this details and Nashirnet is not responsible about any damage may happen for the client due to loss of this details from his side.
All whom order a service considered clearing Nashirnet responsibilities from any legal prosecution, damage or loss caused by his use of the service , also agrees to bears the complete Judicial,financial and ethical caused by his use of the service. And Nashitnet will not Indemnite any client about any kind of loss caused from a governmental decisions (local or international ) against the client .
Nashirnet has the complete right to add,modify or delete and term of this agreement at anytime, and the client has to keep updated to this change even has not been notified.
Servers terms
Nashirnet guarantees a continuous Internet connection for the servers in the datacenter excepting disconnections caused by client unexpected behavior or the general situations outside the datacenter scope. Also excepting the disconnections made for the maintenance and upgrade procedures which will be informed to the clients in advanced. The server considered connected if its replies to the ping command no matter of the server OS or application status.
Nashirnet guarantees a continuous power source for the servers , expecting the power disconnection caused by the client unexpected behavior .
Nashirnet guarantees the replacement of the server parts within tow hours after the client notification through opening a support ticket for the technical support Dept. . The replacement time excluding installation of softwares or operating system on the server.
All IP addresses given with the dedicated server services belongs to Nashirnet , and it's nontransferable or selling , and any using of unassigned IP address by the client is contrary of the terms and conditions.
Laws and Regulations in Saudi Arabia prevent the hosting of VPN servers.
Hosting terms
Nashirnet assumes that the content and use of the shared hosting managed by the clients are legal , and any complaint against any content gives Nashirnet the complete right to suspend the website concerned and notify the concerned client to resolve the problem to unsuspend that service . Such cases includes :
Publishing pictures or text against religion,ethics or honor.
Any try to hack other websites on the same host server
Publishing secret information or “not for publish “ data.
Publishing copyrighted data .
Anything threating or harming a person or a group.
Providing fake data or services .
Publishing viruses or any malware.
Anything related to hacking or spying other websites .
Installing any script may affect the host server performance ( proxy , mass email )
Any fishing websites or pages.
Nashirnet has the complete right to remove a complete or part of the service content if classified as illegal or against the service terms and conditions.
Overloading the server resources threats your service to be suspended.
1000 Email are allowed to be sent per day , and over that will be blocked.
The technical support not including installing or supporting softwares or hacks installed.
In case the client website has been hacked , it's not Nashirnet responsibility to resolve the problem or specifying the cause of the hacking unless it was through a server level threat.
Nashirnet provide daily,weekly and monthly backup for the client website but not guarantees the health of the backup unless agreed with the client on that with extra charges . And the client has the right to ask for restoring any backup by opening a support ticket to the technical support team.
The client has the complete right to take a complete backup of his website if he wants to move out provided that there is no late financial dues.
In case the client moved out to other hosting company , he gain the right to ask again for another complete backup of his website within 1 week of leaving Nashirnet , and after this period Nashirnet has the complete right to permanently delete anything related to the client service (backups, content).
