Third-Party Products and Services Policy

This document forms an integral part of NashirNet's approved Terms and Conditions and must be interpreted and applied together with them. Together, they form the legal and regulatory framework governing the relationship between the Company and the Customer.

Using the website, creating an Account, requesting or using any Service, or continuing to use it constitutes an acknowledgment that you have read and understood this document and expressly and bindingly agree to all of its provisions.

If there is any conflict between the provisions of this document and the Terms and Conditions, the general Terms and Conditions shall prevail, unless the conflict relates to a matter specifically governed by this document. In that case, the provisions of this document shall prevail only in relation to that matter.

This Policy sets out the legal and regulatory framework governing dealings with Products and Services provided by Third Parties independent of NashirNet. It also defines the limits of NashirNet's liability and the Customer's obligations when purchasing, using, or benefiting from such Products or Services.


Scope of Application:

This Policy applies to all Products, Services, licenses, software, or technical solutions provided or made available by NashirNet, or sold, licensed, or enabled for use through NashirNet, where their source, management, or operation is attributable to a Third Party independent of NashirNet, unless expressly stated otherwise in a separate document.


Scope of Third-Party Products and Services:

As part of certain Services or as additional Services (Add-ons), NashirNet may provide Products or Services supplied by external parties independent of NashirNet, including, without limitation:

  • Third-Party licenses and software.
  • Cloud, security, or network Services provided by an external provider.
  • Domain Name registration Services and security certificates.
  • Products or technical solutions provided under distribution or licensing agreements.

The Customer acknowledges and agrees that these Products or Services are not owned or directly managed by NashirNet unless expressly stated otherwise in writing.


Third-Party Terms and Conditions:

All Third-Party Products and Services are subject to the terms, conditions, and policies of the relevant Third-Party providers.

The Customer must:

  • Review the Third Party's terms, conditions, and policies before purchasing or using the applicable Product or Service.
  • Accept and fully comply with them.
  • Bear any obligations, restrictions, or requirements imposed by the Third Party.

NashirNet is not responsible for:

  • The content of the Third Party's terms.
  • Any amendment, update, or change made to them.
  • Any promotional offers, discounts, or benefits determined by the Third Party.

Limitations of NashirNet's Liability for Third-Party Products and Services:

NashirNet provides no express or implied warranties or undertakings regarding:

  • The quality, availability, or continuity of Third-Party Products or Services.
  • The performance, reliability, or compatibility of Third-Party Products.
  • The continued provision or support of Third-Party Products or Services.

The Customer's dealings with Third-Party Products and Services are at the Customer's own risk. NashirNet is not responsible for:

  • Failures, outages, or interruptions.
  • Data loss or system failure.
  • Any direct, indirect, or consequential losses resulting from their use.

Under no circumstances shall NashirNet be deemed an agent, representative, partner, or trustee of the Customer or the Third Party in any transaction relating to Third-Party Products or Services.


NashirNet as a Distributor or Technical Intermediary:

In certain cases, NashirNet may act as a distributor, technical intermediary, or authorized licensee of Products, Services, or licenses provided by a Third Party solely to enable the Customer to use them within the scope of the Services provided.

Any failure, defect, or change affecting Third-Party Products or Services shall not constitute a breach of any contractual obligation by NashirNet. Any rights, claims, or compensation available to the Customer shall be limited to those granted directly by the Third-Party provider under its terms and policies.

The Customer is prohibited from:

  • Copying or modifying Third-Party Products or Services or reverse-engineering them.
  • Reselling, transferring, exporting, or re-exporting them.
  • Using Third-Party Products or Services in violation of the provider's terms or applicable laws and regulations.

Third-Party Websites and Content:

NashirNet's Services or website may include links to websites, content, materials, or information belonging to Third Parties.

NashirNet is not responsible for:

  • The content, accuracy, completeness, or current status of information published on those websites.
  • Their privacy policies or security practices.
  • Their availability or continuity, or any damage resulting from their use.

The Customer accesses or uses Third-Party websites or content at the Customer's own risk. Such websites and content are subject to the terms and policies of the relevant Third Parties.


Suspension, Modification, or Termination:

NashirNet reserves the right to suspend, modify, or discontinue the availability of any Third-Party Product or Service where required by the Third Party's instructions, regulatory or legal requirements, or the expiration or amendment of distribution or licensing agreements.

This shall not create any obligation for NashirNet to compensate the Customer.


Relationship with Other Documents:

This Policy must be read, interpreted, and applied together with:

  • The Terms and Conditions.
  • The Acceptable Use Policy.
  • The Privacy Policy.
  • Any other relevant agreements or policies.

If there is any conflict between the provisions of this Policy and the Terms and Conditions, the general Terms and Conditions shall prevail, unless the conflict relates to a matter specifically governed by this Policy. In that case, the provisions of this Policy shall prevail only in relation to that matter.


Amendments to the Policy:

  • NashirNet reserves the right to amend or update this Policy at any time.
  • Any amendments become effective from the date they are published on the website.
  • The Customer's continued use of any Third-Party Product or Service after the amendments are published constitutes express acceptance of the amended version.
